General Terms and Conditions of Sale

1. Scope of application

The general conditions of sale described below (hereinafter the "General Conditions of Sale") are intended to govern all contractual relations between the site operated by the company PickUp Attitude with a capital of 8,000eur whose headquarters is located: 577 Route des Loubes - RCS Toulon B 492 664 172 (hereinafter " We" ) and customers, aged over 18 years and enjoying full legal capacity (hereinafter " You" ) ordering through the site (hereinafter the " Site" ).

The General Conditions of Sale apply without restrictions or reservations to all sales of products listed in our catalog published on the Site, excluding purchases made directly from our physical establishments PICKUP ATTITUDE.

Placing an order through the Site implies your unreserved acceptance of the General Conditions of Sale. To this end, You confirm that You accept all of the General Terms and Conditions of Sale when You check the "I accept" box when placing your order. We reserve the right to modify these Terms and Conditions at any time. We therefore invite You to carefully read the General Conditions of Sale for each new order placed. The General Terms of Sale applicable will be those in force on the day the order is placed.

The General Conditions of Sale are accessible at any time on the Site and prevail over any other version or any other contradictory document.

2. Your order

The order of the products that You select (hereafter the " Products" ) will be carried out according to the process described below.

Your identification:

You access the contents of your basket, including all the Products. You must then proceed to your identification. In this respect, You undertake to provide Us with accurate and reliable information, thus enabling Us to perform all of our contractual obligations. We cannot be held responsible in the event that the information You have provided proves to be false or incomplete. In this context or in the event of non-payment or any other irregularities on your account, We reserve the right to cancel your order and/or delete your user account. Your identification can be done directly after the selection of Products or through your user account (hereinafter the " Account" ). The opening of an Account includes the entry of two identifiers: an email address and the choice of a password. Your identifiers are personal to you and must be kept confidential.
You can access the personal data that You have communicated to us on request, in accordance with the provisions set out in the Personal Data article of the General Terms of Sale.

Placing your order:

Once the products have been selected and your identification data have been entered, You then proceed to select your method of payment.
A summary of your order is then presented to You, which will include information relating to the Products, the prices and the delivery terms. You will also be given an order number.

Final confirmation of your order:

Once the order is validated, two situations are to be distinguished:
1 - In case of payment by credit card or Paypal: the final validation of your order will occur when the bank authorization of debit will have been given to Us, that is to say within ten (10) days. A final confirmation will then be sent to you, including all elements relating to your order.
2 - In case of payment by bank or postal check: a confirmation of your order will be sent to you after the validation of your order. The final validation of the latter will however intervene from the reception and the verification of the payment. In the absence of receipt and validation of the payment within ten (10) days, We automatically consider the order interrupted.
Only the final validation of the order commits Us contractually to You.

Availability of the products:

The items are offered to You within the limits of available stocks. Thus, in the event of unavailability of the ordered Product, We commit ourselves informing You as soon as possible and will proceed to the refunding of the Product (postal charges included) within a maximum period of 30 days.

3. Product prices

The prices indicated on the Site are indicated "All Tax Included" (TTC), and take into account the possible cost of elimination of waste (the eco-contribution).
Unless otherwise indicated, the prices indicated do not include shipping costs.
We offer you access to information on products that are not sold on the Site, but are available in stores. The prices of products only available in store are given as an indication only. They may therefore vary from those available in store.

4. Payment of your order

You can pay for your purchases by :

Cards accepted: VISA, MASTERCARD or AMERICAN EXPRESS by entering your banking data from the Ultra Secure Site Paypal. All the banking data entered are subject to a secure treatment and are immediately encrypted. This information is only accessible to our banking partner Paypal, so that it can connect with your bank. At no time, we, or any other third party, can access your banking data. Your payments are transmitted to our banking partner on the day of the order.

In case of late payment

In accordance with the regulations in force, any sum not paid on the due date by any professional will give rise to a fixed penalty for collection costs in the amount of forty (40) euros, which will be automatically added to the late payment penalties indicated on your invoice.

5. Security of your means of payment

In order to guarantee a maximum of safety at the time of the orders, all the payments by bank cards are made safe by the system known universally PAYPAL. This system is based on proven cryptographic techniques, thus ensuring the confidentiality and integrity of exchanges. Thus, when you enter your bank details (card number, date of validity, and code .......), these are automatically encrypted and sent in secure mode to an ultra secure server (PAYPAL server), without going through Us.

At the same time, We send to the same server, still in secure mode, data specific to your order (merchant number, transaction number, amount of the order). The PAYPAL system performs a control of the card and a request for authorization from your bank using a private banking network. The PAYPAL system returns the confirmation of payment and sends You back to the Site. The PAYPAL system then takes care of the payment with our banking partner.

6. Delivery of your order

General information

By delivery, we mean all the means made available to you to take physical possession of the Products ordered through the Site. The specificities related to the different delivery methods are detailed below.

Delivery will be made to the address that You indicated when placing your order.

The delivery will take place within the time indicated on the order confirmation that We will have sent You. Deliveries cannot be made on weekends and public holidays. The delivery times run from the day after the payment made by credit card, subject to acceptance of the latter, or from the receipt of the bank or postal check.

We commit ourselves to implement all the means necessary to respect the delivery dates indicated. Also, in the event that We are informed of a delay in delivery, We undertake to inform You as soon as possible. You will then decide whether to maintain or cancel all or part of your order.

If the delivery time exceeds seven (7) days, You have the possibility of cancelling your order, by e-mail at[email protected] or by telephone at 04 94 00 50 95 (not surcharged). Your order will be reimbursed within a maximum of thirty (30) days following receipt of the e-mail. If the delivery has taken place before your cancellation request has been taken into account by our services, we will provide you with a return slip and will indicate the address where the delivered Products can be returned, it being specified that the return costs will be at our expense.

Delivery rates

Shipping costs differ according to the size and type of products for Continental France, contact us for other destinations including Corsica and Drom Tom.

Delivery by parcel post

For Products whose weight does not exceed thirty kilograms (30 kg) and/or whose dimensions do not exceed one meter fifty (1m50), the delivery will be carried out by the means of parcel post, delivered directly to your residence.

In case of absence on the day of delivery, a notice will be left in your mailbox, inviting you to collect the Product from your post office.

Delivery by carrier

For Products whose weight exceeds thirty (30) kilograms and/or whose dimensions exceed one meter fifty (1m50), delivery will be made by a carrier that we have designated.

Delivery means the deposit of the Product in front of your home or at the foot of your building. No handling or installation will be carried out by the carrier. You will therefore be responsible for the collection, storage and installation of the Products at your home.

Only the carrier is entitled to decide on the most suitable place for unloading. It is specified that the delivery will be made at the property line. No unloading at height will be carried out (on a slab for example).

In the event that the actual configuration of the place of delivery physically prevents the unloading of the goods, the carrier reserves the right to cancel the delivery. In this case, the delivery costs will remain at your charge. It will be up to You to approach Us by email at [email protected] or by telephone at 04 94 00 50 95 (not surcharged), in order to fix the new modalities and costs of routing of your order.

In case of absence at the time of delivery, a notice of passage will be left in your mailbox. You will then be invited to contact the carrier or us directly, either by e-mail at[email protected] or by telephone on 04 94 00 50 95 (not surcharged), to agree on a new delivery date and time. The costs of this second delivery will be at our expense.

Only the carrier is entitled to decide on the most suitable place for unloading. It is specified that the delivery will be carried out within the limits of the property. No unloading in height can be carried out (on a slab for example).

7. Compliance of your order

You must open your order and check it. You will sign a delivery or transport note for this purpose. You can make the necessary reservations, detailed, legible, as precise as possible in case of anomalies observed (breakage, damage, non-conformity: error of Product, color and / or different dimensions, missing, etc.). In this case, You must refuse delivery of the package.

You must confirm your reservations either by using the form in the "Contact us" section, or by e-mail to the following address [email protected] or by telephone on 04 94 00 50 95 (not surcharged)specifying the number of the order concerned. If the anomaly is proven, we will implement all the necessary means so that a new delivery intervenes as soon as possible.

Before the first use or start-up of the Product, We expressly recommend that You carefully read the instructions and documents attached to the Products. If necessary, We remind You of the importance of wearing personal protective equipment when using the Products. We shall not be held responsible for any damage resulting from the use of the Products that does not comply with the instructions provided in the notices and documents attached to the Products.

8. Right of withdrawal

Modalities for exercising the right of withdrawal.

In accordance with the regulations in force, for any purchase of Product made on the Site, You have a withdrawal period of seven (7) days from receipt of the goods, allowing You to cancel their orders in whole or in part.

In order to facilitate the management of product returns and to ensure that the Products are transported in the best possible conditions, the Products must be returned in their original packaging, accompanied by all accessories and instructions, in good condition, and accompanied by their invoice.

We will provide you with a return form and will indicate the address where you can return the Products, it being specified that you will be responsible for the return costs.

Terms of reimbursement

In accordance with the legal provisions, We undertake to reimburse You all the sums paid (including shipping costs), within a maximum period of thirty (30) days.

In case of initial payment by credit card, You will be re-credited of the amount directly on your credit card.

In case of initial payment by postal or bank check, We will contact You in order to obtain a bank statement. The transfer will then be made directly to your bank account.

9. Return of the goods

In addition to the right of withdrawal that You have, We allow You to return your purchases during an additional period of three (3) days, from the end of the withdrawal period as specified above.

You will then have to inform Us either by e-mail [email protected] or by telephone at 04 94 00 50 95 (not surcharged) of your will to return your order or a part of it. We will then indicate to You the technical modalities of return of the Products.

In this context, as the return is made outside the withdrawal period as set by law, only the price of the Product, not including shipping costs, will be refunded to You. You will also be responsible for the return shipping costs.
Except for the shipping costs, your order will be reimbursed under the same conditions as those described in the previous article.

10. Guarantees - After-sales service

The contractual guarantees granted

The contractual guarantees relating to the Products, and their conditions of application, are fixed by the supplier of the Product. The contractual guarantees are therefore likely to be different (duration, extent, etc.) depending on the Products, suppliers and brands. You will find the details of these guarantees on the Product presentation sheet, attached to the Product, and specified on the user manual or any other document accompanying the Product.
The guarantee period starts to run from the date of receipt of the Products.
In general, We would like to point out that the following are not covered by the contractual guarantee offered by the suppliers:
- Malfunctions linked to incorrect use and/or a lack of maintenance of the product.
- Malfunctions linked to normal wear and tear of the Products and the replacement of accessories, wearing parts and consumables.
- Damage linked to the various shocks caused to the Products.
Routine maintenance operations (oil changes, adjustments, sharpening, etc.) do not fall within the scope of the contractual guarantee offered by the suppliers.
Independently of the contractual guarantee granted, the Products remain guaranteed under the legal guarantee of conformity and the legal guarantee of defects such as defined in articles L.211-4 and following of the Consumer Code and 1641 and following of the Civil Code.

The after-sales service

We provide an after-sales service for our products. In case of difficulties in the use of the products, You are invited to contact Us, either by e-mail at the following address [email protected] or by telephone at 04 94 00 50 95 (not surcharged). We will then make an initial diagnosis (whether or not the contractual guarantee applies, breakdown, etc.).
The after-sales service can be carried out directly in the store or by returning the Product.
In the case of a return of a Product, and at the end of the diagnosis that We will have carried out, if the problem linked to the Product is covered by the contractual guarantee of the supplier, a return form will be sent to You, allowing You to send the Product to Us, free of charge. The repairs will then be carried out and the Product will be returned to You, without You incurring any additional costs.
However, if the warranty is not applicable, a repair estimate will be sent to You. If You accept the estimate, You must inform Us of Your acceptance. In this case, the return of the Product will be at Your own expense.

11. Responsibilities

Our responsibility cannot be engaged when You do not respect, in whole or in part, the General Conditions of Sale, or in case of unforeseeable fact of a third party or in case of force majeure.

We can in this case exonerate us from all or part of our responsibility by bringing the proof of the non-execution or the bad execution of the present General Conditions of Sale, either when this one is imputable to You or, when it is the unforeseeable and insurmountable fact of a third party to the contract or then consecutive to a case of absolute necessity recognized as such by the jurisprudence.

12. Reservation of ownership

The delivered goods remain our property until full payment of their price. Failure to pay may lead to the reclaiming of the goods.
The transfer of the risks of loss or deterioration is nevertheless carried out between your hands as from the delivery of the products.

13. Personal data

Placing your order via the Site implies that we collect your personal data. We therefore invite you to consult the section that we put online on our Site.

14. Applicable law and competent court

The General Terms and Conditions of Sale are subject to French law for all their stipulations. All disputes relating to the commercial relationship between You and Us are subject to the exclusive jurisdiction of the French courts.
In case of dispute, an amicable solution will first be sought. The search for an amicable solution does not interrupt the contractual guarantee but interrupts the time limits for action from which You benefit
